The “Mountain of Good”: Terms of Use of the social network

Introduction

The Archdiocese of Kraków, having its headquarter at Franciszkańska 3 street (postcode: 31-004), Kraków, Poland runs the social network called the “Mountain of Good” (hereinafter referred to as the Social Network) which is a continuation of a place of meeting for Volunteers of the World Youth’s Days Kraków 2016 (hereinafter referred to as Volunteers.). The Social Network’s role is to create a place for volunteers’ community which is proactive and based on the Christian values. It is a platform of the communication and the management of Volunteer’s work, and the news about the WYD (the next editions), and the meeting place where the Volunteers can share with each other what they are doing.

These Terms of Use were created based on the effective laws in the European Union, in particular based on the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) which on 25 May 2018 replaces regulations that have been effective in the Republic of Poland, in particular on the basis of the Act of 29 August, 1997 on the Protection of Personal Data and the Act of 18 July, 2002 on Providing Services by Electronic Means. The Terms of Use determine rights and responsibilities of the Users and the rights, responsibilities and the scope of responsibilities of the Archdiocese of Kraków, the Database Administrator (hereinafter referred to as the Administrator).

I. Basic notions of the Terms of Use:
  1. Administrator – the Archdiocese of Kraków having its headquarter at Franciszkańska 3 street (postcode: 31-004), Kraków, Poland.
  2. Volunteer – a natural person, registered on the Social Network as a volunteer, including Volunteers of the World Youth’s Days Kraków 2016.
  3. The Social Network – the social network website called the “Mountain of Good” that works for Volunteers and the Coordinators who are creating the community of proactive people who promote volunteering based on Christian values.
  4. Coordinator – a person chosen to be not only the administrator of the Social Network website but also the project coordinator.
  5. User – a Volunteer or a Coordinator who has the account in the Social Network.
  6. The Account – an individual account of anyone who registers on the Social Network.
  7. The Contract – the Volunteer’s Contract that is an agreement concluded between the Archdiocese of Kraków and the Volunteer. The agreement in concluded by both parties by activating the User’s profile entitling to use the Social Network.

I. PARTICIPATION IN THE SOCIAL NETWORK

  1. The Social Network is designed to be used only by the Volunteers and the Coordinators.
  2. By accepting the Terms of Use, the Volunteers or the Coordinators agrees with the terms and obligates himself or herself to follow the terms. Exploiting the Social Network equals agreeing with the terms.
  3. Exploiting the Social Network by the Volunteers or the Coordinators is voluntary and free.
  4. When the Volunteer or the Coordinator creates the account on the “Mountain of Good” Social Network it will be an active account as long as the User will express the wish to close and delete the account on the Social Network.
  5. The Volunteer gives a consent to the processing of one’s personal data that are given to the Social Network during the registration process on the following website: https://register.wyd.va, according to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) which on 25 May 2018 replaces regulations that have been effective in the Republic of Poland, in particular on the basis of the Act of 29 August 1997 on the Protection of Personal Data. Accepting the Terms of Use by the Volunteer or the Coordinator equals giving the following statements:
    1. a. I declare that I have read the Terms of Use and I have accepted all of the terms;
    2. b. I have voluntary started exploiting the Social Network;
    3. c. all of the personal data included to the registration form are genuine. All of the information and photos posted on the “Mountain of Good” are real and their publication do not violate the rights of others;
    4. d. I hereby agree for processing my personal data only for the purposes of the further usage of the Social Network, which continuously creates a place of meeting for the Volunteers as well as performs a role of a platform for the proactive volunteers’ community to promote the Christian values, to ease the communication process, and to enable coordinating volunteers’ work. The data will only be processed to the extent and purposes specified by the regulations effective in the Republic of Poland, in particular on the basis of the Act of 29 August 1997 on the Protection of Personal Data and the Act of 18 July 2002 on Providing Services by Electronic Means and implementing regulations to these Acts. I also agree for transferring my personal data to third parties (companies, public institutions, etc.) which will be involved in operations of the Social Network only to the necessary extent. The Administrator of the Data in Poland is still the Archdiocese of Kraków having its headquarter at Franciszkańska 3 street (postcode: 31-004), Kraków, Poland. I acknowledge that submitting my personal data is voluntary and I shall have the right to access and correct it;
    5. e. I am aware of the consequences of posting on the Social Network others’ personal data or photos without their consent;
    6. f. I accept and undertake myself to exploit the “Mountain of Good” in accordance with the Terms of Use and the purpose of the Social Network.

II. PRIVACY

  1. According to the Privacy Policy which is the 1th Attachment to the Terms of Use, the Administrator is allowed to gather the information about the registration and other information about the Volunteers or Coordinators.

IV. THE TERMS OF USING THE SOCIAL NETWORK

  1. Registered Volunteers have the access to the following data about other Volunteers or Coordinators:
    1. (i) name and surname,
    2. (ii) photo (if it is posted by the user).
  2. Registered Coordinators have the access to the following data about Volunteers or other Coordinators:
    1. (i) name,
    2. (ii) surname,
    3. (iii) photo (if attached by the User),
    4. (iv) country,
    5. (v) e-mail address,
    6. (vi) phone number,
    7. (vii) mother tongue/ spoken foreign languages,
    8. (viii) abilities and/or experience.
  3. The activities that obstruct or destabilize the Social Network in any way or jeopardize the Social Network’s reputation are unacceptable. In case the Administrator finds out that a Volunteer or a Coordinator commits the forbidden acts, the Administrator can immediately block or even delete the account. An attempt of destabilizing acts of a Volunteer or a Coordinator can be found as a crime, in particular in the light of the penal code.
  4. By registering to the “Mountain of Good” a Volunteer or a Coordinator especially undertakes to:
    1. a. restrain oneself from any actions obstructing or disrupting the running of the Social Network;
    2. b. observe the royalties and the financial copyrights of registered inventions, patents, trademarks, utility models and industrial designs of the Administrator and others;
    3. c. restrain oneself from any acts that infringe the privacy of the other users, above all from collecting, processing and publicizing the information of the other users without their clear consent. With the exception when the acts are according to the terms of these Terms in Use;
    4. d. not take any harming acts against the Administrator, other users or third parties. In particular acts like posting humiliating, disrespecting and destroying the reputation of these people or using false or confidential information;
    5. e. restrain oneself from any acts that spreads propaganda or from possessing any symbols that are illegal in the Republic of Poland;
    6. f. restrain oneself from any actions that are used to obtain from other users their passwords and identification data, especially for commercial or illegal purposes;
    7. g. restrain oneself from any acts using Viruses, Bots, Worms or any other computer codes, folders or programs that stop, destroy or limit running of the Social Network and computer equipment or in any way enable unauthorized use or access to a computer or computer network.
  5. The users are not allowed to post and propagate on the Social Network:
    1. a. software without having a proper authorization;
    2. b. software designed to unauthorized destructing, altering , deleting, obstructing the access to IT data, interfering with or prevent the functioning of automatic processing, collecting and transmitting the data or interfering with the functioning of systems and ICT network;
    3. c. computers’ passwords, access codes or other data enabling unauthorized access to the information stored in the computer system.

V. THE RIGHT TO EXPLOITING OF THE SOCIAL NETWORK

  1. Adults (above 18 years of age) can be a user of the Social Network.
  2. Underage user (below 18 years of age) of the Social Network by accepting the Terms of Use declares that one poses the consent of the legal guardian for creating an account on the Social Network and processing personal data.
  3. Underage user of the Social Network restrain oneself to submit during the account’s activation an email of the legal guardian in order to confirm the identity and the consent of the legal guardian for creating an account by the underage user who is under the legal guardian care.

VI. PAYMENT OF EXPLOITING OF THE SOCIAL NETWORK

  1. Exploiting of the Social Network is free.

VII. COPYRIGHTS

  1. The Archdiocese of Kraków runs the Social Network with the respect to the intellectual property rights. The Social Network for the Volunteers the “Mountain of Good” includes the contents under the copyright protection. The name of the Social Network, as well as the graphic marks can be or are registered trademarks or brand names. Exploiting of the materials, information and data posted on the Social Network does not mean the user acquires any of the rights on the intangible assets with the works included in the Social Network. The user can use these works only in the amount permitted by the Act of 4 February on Copyright and related rights (Dz. U. [Journal of Laws] No.24, item 83 as amended). The users of the Social Network take all the responsibilities for the actions against the copyrights.

VIII. THE AMENDMENTS IN THE TERMS OF USE

  1. The Administrator is authorized to update the Terms of Use. The users will be noticed in advance about any amendments of the Terms of Use to enable acquainting oneself with the contents of the changes. Further exploiting of the Social Network equals accepting the amendments.

PRIVACY POLICY

§ 1The object of regulation and the legal regulation in force

As the Archdiocese of Kraków is respecting the privacy of the Volunteers and the Coordinators, on the basis of §II of the Terms of Use was issued this Privacy Policy (“the Policy”). The Policy regulates the scope, the purpose and the ways of processing personal data of the Users (“ the Data”) by the Archdiocese of Kraków due to the running of the “Mountain of Good”.

§ 2 The Notions

The notions used in the Policy are written in the capital letters and the undefined notions have the meaning given in the content of the Terms of Use.

§ 3 The Administrator

The Administrator of the Data is the Archdiocese of Kraków. The Archdiocese can entrust the right of processing the Data to the other entity in the compliance with the law on the basis of the Contract of processing the Data. This entrusting of processing the Data to another entity does not constitute the amendment of the Terms of Use.

§ 4 The scope and the purpose of the Data processing

The scope and the purpose the Data processing are in the form stipulated by the law, in particular with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) which on 25 May 2018 replaces regulations which have been effective in the Republic of Poland, in particular on the basis of the Act of 29 August 1997 on the Protection of Personal Data and implementing regulations to these Acts.

§ 5 The authorization of the Data processing

The basis of the processing of the personal data is the User’s agreement, as well as the statutory authorization of the data’s processing required for the realization of the tasks by the Archdiocese of Kraków in connection with the activities related to the Social Network purposes, which is continuously creating a place of meeting for the Volunteers as well as performing a role of a platform for the proactive former World Youth Day Kraków 2016 volunteers’ community to promote the Christian values and encourage others to share good.

§ 6 The Ways of the Data processing

The Data are processed especially in the IT system by the Social Network and the tools used to registration and identification of the Users.

§ 8 Gathering of the Data

Submitting any Data is voluntary; however, submitting the following information is necessary to sign the Contract and a proper functioning of the Social Network:

    1. 1) name,
    2. 2) surname,
    3. 3) country,
    4. 4) e-mail,
    5. 5) phone number,
    6. 6) mother tongue/spoken foreign languages
    7. 7) abilities and/or experiences.

The User by one’s account has the right to see one’s own Data and change them.

§ 9 Operating Data

The user agrees to the processing of operating data, which are mentioned in the Art. 18 par. 5 of the Act of 18 July, 2002 on Providing Services by Electronic Means. The Archdiocese of Kraków uses system log, in particular IP addresses gathered during the internet connections for the technical purposes. The system logs are connected with the server administration and the information gathered by the cookies enables to adapt the contents of the “Mountain of Good” to the individual needs and preference of the Users. The system logs are also used to create general statistics on exploiting of the Social Network by the users.

§ 10 Transmitting of the Data

The Archdiocese of Kraków is not transmitting the Data to any third parties, the exception are the cases when the Terms of Use allows it and it is necessary for the proper functioning of the Social Network.

The Archdiocese of Kraków will share the Data with the  law enforcement agencies, courts and the third parties when the Administrator is obligated to do it by the law in the Republic of Poland.

§ 11 Security procedures

The Archdiocese of Kraków implements all necessary procedures assigned by the law to maintain the Data’s security. In particular the Archdiocese of Kraków introduced and is still using the high level of security in the IT system, as well as it organized and introduced the security policy and the instruction of the IT system’s management. All that have the access to the Data have been acquainted with the regulations about the case of personal data’s security. The IT system is equipped with the proper security to prevent the access of the unauthorized people.

§ 12 The ceasing of the Data processing

The Archdiocese of Kraków ceases the Users’ Data processing after the cancellation or expiration of the Contract. Afterwards, the Administrator takes necessary measures for the quick cancelling of the Data of the former Volunteer or Coordinator that are in the possessions of the Administrator, excluding the Data that according to the law can be still processed.

§13 Amendments of the Policy

Amendments of the Policy are made in the procedure stipulated for the amendments of the Terms of Use.
